Seller identity and scope
The website puliafico.art is dedicated to presenting and selling original artworks by the artist Antonino Puliafico.
These Terms and Conditions govern access to the website and purchases made through the online store. Before completing an order, the purchaser should carefully read these Terms, the Refund Policy, the Shipping Policy and the Privacy Policy.

Original artworks
Unless otherwise stated, each artwork offered for sale is an original and unique piece personally created by Antonino Puliafico.
The main characteristics of each artwork, including its title, medium, surface, dimensions, year and framing status, are provided on the relevant product page.
Every effort is made to represent the artwork accurately. However, colours and brightness may appear slightly different depending on the screen, device and lighting conditions. Images showing artworks displayed in interiors may be for illustrative purposes; the dimensions stated on the product page should always be used to evaluate the artwork’s actual proportions.
Availability
As every artwork is unique, only one original is available.
Antonino Puliafico may also present artworks through galleries, exhibitions or other platforms. In the exceptional event that an artwork has already been sold when an order is received, the purchaser will be informed promptly and any amount already paid will be refunded in full.
Orders and contract formation
To place an order, the purchaser must provide complete, accurate and up-to-date information.
Receipt of an order is normally confirmed by email. The sales contract is concluded when the order is accepted and confirmed, subject to the artwork’s availability, the absence of an obvious pricing or listing error, fraud prevention checks and the ability to arrange delivery to the stated destination.
If an order cannot be accepted after payment has been made, the amount received will be refunded without undue delay.
Prices
Artwork prices are displayed in euros unless another available currency is selected on the website.
Shipping costs are displayed or calculated during checkout. A personalised shipping quotation may be required for large-format artworks or particular destinations.
Customs duties, import taxes and other charges imposed by the destination country are borne by the purchaser unless otherwise stated.
Payments
Payments are processed using the payment methods available through Shopify checkout. The availability of individual payment methods may vary according to the country, currency and device used.
Antonino Puliafico does not directly receive or store complete payment-card details.
The artwork may be prepared and dispatched after payment has been confirmed.
Certificate of authenticity
Each original artwork is supplied with a certificate of authenticity unless otherwise stated on the product page.
The certificate forms an integral part of the artwork and should be kept safely. If the artwork is returned, the certificate must also be returned.
Shipping and delivery
The preparation, packaging, insurance, shipping and delivery-inspection procedures are described in the Shipping Policy.
Stated delivery times are estimates and may vary due to the destination, artwork dimensions, customs procedures, the courier, exceptional events or circumstances beyond reasonable control.
The purchaser is responsible for providing an accurate delivery address and should promptly report any error or expected period of absence.
Withdrawal, returns and refunds
The conditions for exercising the right of withdrawal and returning an artwork already available in the catalogue are set out in the Refund Policy.
The purchaser should review that policy before completing the order, particularly for large-format artworks, for which direct return costs may be significant.
Artwork damaged during transport
Upon delivery, the purchaser should inspect the packaging. If visible damage is present, the shipment should be accepted with a specific written reservation clearly describing the damage on the courier’s delivery document or electronic device.
Any damage should be reported promptly. The purchaser should retain all packaging and provide photographs of the external packaging, internal protective materials and artwork.

Commissioned artworks
Commissioned artworks are also governed by the specific arrangements agreed with the customer, including the subject, dimensions, medium, completion time, price, any deposit and delivery conditions.
Where an artwork is created specifically according to the customer’s individual and clearly personalised instructions, the right of withdrawal may be excluded where permitted by applicable law. Any such exclusion must be communicated before the commission is confirmed.
Intellectual property
Purchasing an artwork transfers ownership of the physical painting but does not transfer copyright or any rights of reproduction, publication, distribution, adaptation or commercial exploitation of its image.
The images, texts, logo, photographs and other content on this website belong to Antonino Puliafico or their respective rights holders and may not be used commercially without prior written permission.
The purchaser may photograph and share the artwork for personal, non-commercial purposes, citing the artist’s name whenever reasonably possible.
Proper use of the website
The website must not be used for unlawful or fraudulent activities or in any manner that infringes the rights of third parties.
Users must not attempt to compromise the store’s security, operation or accessibility, collect data without authorisation, introduce malicious code or use the content in a deceptive manner.
Limitation of liability
Antonino Puliafico endeavours to keep the information published on the website accurate and up to date. Material errors, temporary interruptions, delays or technical issues may nevertheless occur.
Nothing in these Terms excludes or limits any liability or right that cannot lawfully be excluded under applicable law.
Antonino Puliafico is not responsible for delays or failure to perform caused by unforeseeable events or circumstances beyond reasonable control, without prejudice to any mandatory legal obligations.
Third-party services
The website uses Shopify and may integrate external services for payments, shipping, communications, analytics and other functions required to operate the online store.
Use of these services may also be subject to the respective providers’ terms and policies. The processing of personal data is described in the Privacy Policy.
Governing law and disputes
These Terms are governed by Italian law, without prejudice to any mandatory protections available to purchasers under the law of their country of residence.
Where the purchaser qualifies as a consumer, the court of the consumer’s place of residence or domicile remains competent where required by applicable law.
Before beginning formal proceedings, the parties are encouraged to seek an amicable solution through direct communication.
Changes to these Terms
These Terms may be updated to reflect legal, technical, organisational or commercial changes.
The version applicable to an order is the version published and made available at the time of purchase.
